Terms of Service
Please read these Terms carefully before using ArchiMind. By creating an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ArchiMind ("ArchiMind," "we," "us," or "our"), accessible at www.archimindcbc.com, governing your access to and use of the ArchiMind platform, including the web application, Revit add-in, APIs, and all related services (collectively, the "Service").
You must affirmatively accept these Terms by checking the acceptance box during account registration. Passive use of the Service does not constitute acceptance. If you do not agree to these Terms, you may not create an account or use the Service. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization.
ArchiMind technology is protected by U.S. Patent Application No. 63/722,847 and other pending intellectual property rights.
2. Service Description
ArchiMind provides an AI-assisted building code analysis platform operating as: (a) a native add-in to Autodesk Revit that reads room geometry, door parameters, and spatial relationships directly from live building models and transmits extracted geometric data to ArchiMind servers for compliance analysis; and (b) a web application at www.archimindcbc.com that accepts uploaded architectural floor plan documents for AI-based analysis. Both embodiments apply a structured compliance rule engine against the California Building Code (CBC), Division of the State Architect (DSA) requirements, California Access Compliance (DSA-AC), and California Department of Education Title 5 regulations, generating compliance reports for use as design assistance tools.
The Revit add-in includes the following network-connected behaviors you should be aware of:
- Update checks: On each Revit startup, the add-in makes a background HTTP request to www.archimindcbc.com/installers/version.json to check whether a newer version is available. This check is non-blocking and never delays Revit startup. If a newer version exists, a non-intrusive dialog is shown.
- Dashboard sync: After a compliance analysis run, the add-in transmits the compliance report data to your ArchiMind dashboard at www.archimindcbc.com so results are accessible in your web Project History and Memory features.
- Local config file: The add-in reads and writes a configuration file at %APPDATA%\ArchiMind\config.json on your machine to store the dashboard URL and user preferences. This file remains on your machine and is not transmitted to ArchiMind.
3. No Professional or Architectural Services
ArchiMind is not a licensed architectural, engineering, or building code consulting service. No output, report, overlay, recommendation, or other result generated by the Service constitutes a professional architectural opinion, a code compliance determination, a DSA submittal review, or a design recommendation of any kind.
The architect of record, engineer of record, or other licensed design professional bears sole and exclusive professional responsibility for all design decisions, code compliance determinations, and regulatory submissions made in connection with any project. ArchiMind expressly disclaims any responsibility for: (a) DSA plan check submissions or responses; (b) local building department permit applications; (c) construction documents prepared in reliance on Service outputs; (d) any determination of compliance or non-compliance with any building code, regulation, or ordinance.
All Service outputs must be independently reviewed and verified by a qualified licensed professional before any design, permitting, construction, or regulatory use.
4. AI Disclaimer and Output Limitations
The Service uses artificial intelligence and machine learning technologies to analyze architectural drawings and apply building code rule sets. You acknowledge and agree that:
- AI-generated results may contain errors, omissions, misidentifications, or inaccuracies.
- Results do not constitute a guarantee of compliance or non-compliance with the CBC, DSA requirements, CDE Title 5, IBC, ADA Standards, or any other code, regulation, or ordinance.
- ArchiMind results have not been reviewed or approved by the California Division of the State Architect, any local building department, or any regulatory authority.
- Results may not reflect current code editions, local amendments, project-specific variances, or conditions not visible in the analyzed drawings.
- The Service does not perform structural analysis, MEP system analysis, life safety system design, or any other licensed engineering service.
- The Project Memory AI feature allows natural language queries across your project history. Memory query responses are AI-generated and carry the same limitations as all other Service outputs.
Code references are based on CBC 2025 and CBC 2022 editions. Users are responsible for verifying applicability of the correct code edition to their specific project.
5. Account Registration and Eligibility
You must be at least 18 years of age to create an account. By registering, you represent that you are 18 or older and have the legal capacity to enter into binding agreements. The Service is not directed to children under 13, and we do not knowingly collect information from children under 13.
You agree to provide accurate, current, and complete information during registration and to keep your account credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at info@archimindcbc.com if you suspect unauthorized access.
6. License and Permitted Use
Subject to your compliance with these Terms and payment of applicable fees, ArchiMind grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your internal business purposes during the subscription term.
The Revit add-in is licensed software and may only be installed on machines owned or controlled by the licensed user. Each license key may only be activated on the number of machines corresponding to your subscription plan (one machine for Solo; up to five machines for Firm). You may not share, transfer, resell, or sublicense your license key.
You agree not to:
- Decompile, reverse engineer, disassemble, or attempt to derive source code from the Service or add-in.
- Upload drawings or files you do not own or have no right to process.
- Upload files containing malware, unauthorized personally identifiable information, or content that violates third-party rights.
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to circumvent, disable, or interfere with security features, license enforcement, access controls, or update checks.
- Modify or replace the add-in's config.json to redirect dashboard sync traffic to unauthorized endpoints.
- Resell, redistribute, or make the Service available to third parties outside your licensed seats.
- Use automated scripts or bots to access the Service in a manner that exceeds normal usage.
7. User Content and Intellectual Property
Your content. You retain full ownership of all architectural drawings, floor plan documents, Revit model data, and other content you upload or submit to the Service ("User Content"). Nothing in these Terms transfers ownership of your User Content to ArchiMind.
License to process. By uploading User Content or running the Revit add-in, you grant ArchiMind a limited, non-exclusive, royalty-free license to access, process, analyze, transmit, and store your User Content solely to provide the Service to you, including dashboard sync, Project History, and Project Memory features. This license terminates when your User Content is deleted from our systems pursuant to our retention policy.
No training use. ArchiMind will not use your User Content to train, fine-tune, or improve AI or machine learning models without your explicit written consent.
Generated outputs. Compliance reports, overlays, JSON outputs, and Project Memory query responses generated by the Service are provided to you under the same limited license as the Service. Outputs are provided "as-is." ArchiMind does not transfer intellectual property rights in the underlying rule engine, codebook, or AI models through delivery of Outputs.
Upload representation. By uploading any file or running the Revit add-in on a model, you represent and warrant that you own the content or have obtained all necessary rights, licenses, and consents to upload and process the content through the Service, and that doing so does not violate any confidentiality obligation, third-party intellectual property right, or applicable law.
8. Confidentiality
ArchiMind acknowledges that architectural drawings and project data submitted to the Service may be confidential and commercially sensitive. ArchiMind will not disclose your User Content to third parties except as necessary to provide the Service (including transmission to AI processing services under data processing agreements), as required by law, or as described in our Privacy Policy.
For enterprise customers with heightened confidentiality requirements, a separate Confidentiality Addendum or Data Processing Agreement is available upon request at info@archimindcbc.com.
9. Fees, Billing, and Cancellation
Subscription fees are charged in advance on a monthly basis as described on the pricing page. All fees are in USD. Payment is processed by Stripe. By providing payment information, you authorize ArchiMind to charge your payment method for all applicable fees.
Subscriptions automatically renew monthly unless cancelled before the renewal date. You may cancel at any time through your account billing settings. Cancellation takes effect at the end of the current billing period. License keys are deactivated upon cancellation.
Refund policy. Fees are non-refundable after the first analysis run is executed. If you have not run an analysis, you may request a full refund within 7 days of initial purchase by contacting info@archimindcbc.com. ArchiMind reserves the right to issue refunds at its sole discretion in exceptional circumstances.
ArchiMind reserves the right to change pricing with 30 days advance notice to your registered email address. Continued use after the notice period constitutes acceptance of the new pricing.
10. Warranty Disclaimer
The service is provided "as is" and "as available" without warranty of any kind.
ArchiMind expressly disclaims all warranties, express or implied, including but not limited to: implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, and any warranty that the Service will be uninterrupted, error-free, or free of harmful components. ArchiMind makes no warranty that results generated by the Service are correct, complete, or compliant with any building code, regulation, or professional standard.
11. Limitation of Liability
To the maximum extent permitted by applicable law, ArchiMind and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to: lost profits, lost revenue, loss of data, costs of correction, construction errors, design defects, code violations, DSA plan check rejections, permit denials, or any other damages arising from reliance on Service outputs, regardless of the theory of liability and even if ArchiMind has been advised of the possibility of such damages.
ArchiMind's total aggregate liability to you for any and all claims arising out of or related to these Terms or the Service shall not exceed the greater of: (a) the total fees paid by you to ArchiMind in the twelve (12) months immediately preceding the claim, or (b) one hundred dollars ($100.00). This limitation applies regardless of the form of action.
12. Indemnification
You agree to indemnify, defend, and hold harmless ArchiMind and its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of or reliance on the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; (e) any claim that your User Content infringes any third-party right; or (f) any professional liability arising from design decisions, code submissions, or construction activities in which Service outputs were used.
13. Termination
ArchiMind may suspend or terminate your access to the Service at any time, with or without notice, for any material violation of these Terms, including unauthorized use of license keys, uploading of prohibited content, or non-payment. Upon termination, your license immediately terminates and your license key is deactivated.
You may terminate your account at any time by cancelling your subscription and contacting info@archimindcbc.com to request account deletion. Sections 3, 4, 7, 10, 11, 12, 14, and 15 survive termination.
14. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, conducted in Orange County, California. The arbitrator's decision shall be final and binding.
Class action waiver. You waive any right to participate in a class action lawsuit or class-wide arbitration against ArchiMind. All disputes must be brought in your individual capacity.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Subject to the arbitration clause above, you consent to personal jurisdiction in the state and federal courts located in Orange County, California.
16. Changes to Terms
ArchiMind may update these Terms by posting a revised version and updating the Effective Date. For material changes, we will provide at least 30 days advance notice by email to your registered address. Continued use after the notice period constitutes acceptance of the revised Terms.
17. General
These Terms, together with the Privacy Policy and any applicable Enterprise Agreement, constitute the entire agreement between you and ArchiMind with respect to the Service. If any provision is found unenforceable, the remaining provisions remain in full force. You may not assign these Terms without ArchiMind's written consent.
